Everyday products such as shampoo, deodorant and make-up contain chemicals linked to cancer, birth defects and other serious health consequences. Cosmetics manufacturers are allowed to use almost any chemical as an ingredient without government approval; however, some leading companies agree that cosmetics should be made with safe, non-toxic ingredients. Over 600 companies have signed the Compact for Safe Cosmetics, a pledge to make safe products and the campaign is calling for all cosmetics companies to do the same.

A Johnson & Johnson production plant in Fort Washington, PA has suspended production after a recent inspection. During the inspection it was revealed that the plant was in poor condition, with thick layers of dust and contaminated products. Samples of products were tested and results showed formation of bacteria. As a result the FDA is urging consumers to not buy Tylenol, Motrin, Benadryl and Zyrtec for children and infants, after the products were recalled on Friday.

The Campaign for Safe Cosmetic released a report in March 2009 that revealed 23 out of the 28 children’s bath products they tested contained formaldehyde, a chemical that increases skin sensitivity and irritates nasal and respiratory passages in addition to being considered a probable carcinogen by the EPA. 32 of 48 tested products contained 1,4-dioxane, which is also considered a probable human carcinogen by the EPA and a byproduct of the chemical processes used to make petroleum-based ingredients gentler to the skin. Nearly two-thirds of all tested products contained both of these harmful toxins. Brands tested in this study include Bath & Body Works (Limited Brands), Johnson & Johnson, CVS/Pharmacy, Unilever, L’Oreal, Wal-Mart, Kimberly-Clark, Target, Costco and Procter & Gamble. Organic Consumers Association has also recently released a report on brands that have sharply reduced levels of 1,4-dioxane since March 2008 that include 365 Everyday Value (Whole Foods), Earth Friendly Products, Ecco Bella, Giovanni, Jason, Johnson & Johnson, Kiss My Face, Life Tree, Method, Nature’s Gate, Planet Ultra, and Seventh Generation.

Johnson & Johnson faces a federal lawsuit filed by Elizabeth Barroso of Plano, Texas, who suffered a miscarriage and developed potentially life-threatening blood clots after using the Ortho Evra birth control patch for three weeks. The plaintiff alleges that the package insert was misleading and in direct conflict with Johnson & Johnson’s data. According to John David Hart, Barroso’s attorney, "This young lady's life was put in jeopardy by a company that made a harmful product.”

Johnson & Johnson is also facing nearly 500 lawsuits from other claimants citing death and injury as a result of the Ortho Evra birth control patch. Many of these lawsuits were cases of women ages 17 to 30 experiencing severe blood clotting, heart attacks and strokes, all conditions virtually unheard of for this age group. In an effort to avoid the media and more lawsuits, the company is quickly settling the majority of these cases out of court.

Johnson & Johnson is being sued by the Center for Environmental Health in Oakland, CA for the presence of lead in their baby powders. Lead has been identified by the federal government as the foremost environmental health threat to American children. Nearly one million children still have elevated blood lead levels, over four percent of the population. Now, according to San Francisco's Center for Environmental Health (CEH), infants may be exposed through the most unlikely of sources--medicated baby powders.The CEH filed suit against the manufacturers of the powders, and several retail distributors, including RiteAid, Safeway and three online Internet drug stores (Drugstore.com, More.com and PlanetRx.com) for silently exposing consumers, especially children, to lead. The CEH claims the companies are in violation of California's Proposition 65, also known as the Safe Drinking Water and Toxic Enforcement Act of 1986, which identifies chemicals known to the state to cause cancer or reproductive harm.

In October 2002 Johnson & Johnson was ordered to pay Amgen Inc. $150 million in a dispute over sales of erythropoetin, an anemia fighting drug jointly marketed by the two companies. According to a 1985 agreement the drug was to be marketed by Amgen to anemic dialysis patients, while Johnson & Johnson was to market the product to anemic chemotherapy patients and the rest of the market. However an arbitrator found that Ortho Biotech, a subsidiary of Johnson & Johnson, improperly sold its version of the drug, called Procrit, to dialysis patients.

Johnson & Johnson has agreed to pay a settlement of up to $860 million after a class action lawsuit accused the company of giving consumers incorrect instructions regarding the wearing of contact lenses. Johnson & Johnson allegedly misled consumers by recommending that they use 1-Day Acuvue disposable contact lenses only once, although the lenses are just the same as regular Acuvue lenses, that can be worn for 2 weeks. Using this marketing ploy, lawyers' consultants contend that "Johnson & Johnson bilked consumers out of more than $1.1 billion through its labeling and packaging of the 1-Day Acuvue lenses."

In May 2001, Johnson & Johnson agreed to pay $60 million to settle an antitrust case in which the company was accused of conspiring with other companies in refusing to sell contact lenses through alternative channels of distribution, including mail-order companies, which often offer lower prices.
