IBM is the target of a series of lawsuits brought about by former workers who claim that they were exposed to cancer-causing chemicals. Forty-five plaintiffs from the company's San Jose facility brought suit against the company, citing personal injury and wrongful death. The plaintiffs are surviving family members of workers who have died of cancer or former workers suffering from cancer.The company is accused of not taking the necessary precautions for employees who worked in these rooms, and of failing to conduct the tests. As of February 2004, the number of lawsuits hovered around 200. Many cases have been settled confidentially out of court, including over 50 in June 2004, but others' outcomes remain pending.

In May 2001, IBM settled with two plaintiffs who had claimed that exposure to toxic fumes at the company's Fishkill, NY facility caused birth defects in their son. The details of the settlement, which asked for $40 million in damages, remained confidential. The settlement was part of a larger on-going dispute between the company and 220 of its employees in San Jose, New York and Vermont over exposure to toxics in various IBM facilities.

IBM’s score placed it behind HP and Dell, tied with Sony and ahead of Apple, Gateway and Acer.

According to the nonprofit investigative journalism group the Center for Public Integrity, IBM is responsible for 28 current or former Superfund sites. Superfund sites are locations designated by the Environmental Protection Agency as being so contaminated by toxic chemicals that they are dangerous to human health. Companies found responsible for superfund sites are required to either pay for the cleanup personally, or to pay the Environmental Protection Agency to conduct the cleanup. IBM, which is designated as bearing full responsibility for one site, and shared responsibility for 27 others, has only successfully cleaned up 2 sites since the Superfund law was passed in 1980.

In September 2004 IBM agreed to settle all but two claims in a lawsuit accusing the company of having a pension plan that discriminated against older workers, in exchange for a limit of $1.4 billion on its potential liability. Under the terms of the settlement, current and former IBM employees in the suit would be eligible to receive an incremental pension benefit worth an estimated $300 million.

After a drawn-out appeals process, the Khulumani Support Group has won the right to have its case against more than 20 western companies heard in New York district court. The Khulumani Group originally brought suit in the name of thousands of survivors and victims of the South African apartheid regime, claiming in 2002 that not only had the accused companies profited from the apartheid system, but they had been directly involved in propping up the regime. The New York circuit court of appeal overturned a lower court ruling that dismissed the case, meaning that some of the most profitable companies in the world will have to confront allegations that they have been complicit in horrendous violations of human rights. Among the defendants are banking powerhouses Citigroup and JPMorgan Chase, automakers Daimler AG, Ford Motor Company and General Motors, oil companies BP, ExxonMobil, Shell Petroleum, Chevron and finally, technology giant IBM.
